CSARMP SUBSCRIPTION AGREEMENT
Thank you for subscribing to Child Support Audits and Record Management Program (Records Prepared=Justice Served). Your satisfaction is important to us and we will strive to include you as one of our thousands of satisfied subscribers.
Child Support Audits and Record Management Program (CSARMP) is the sole property of Child Support Audits, LLC. Any duplication or unauthorized use of this program or its content is strictly prohibited.
You may not copy, modify, display, license, distribute, transmit, re-post, or download any part of the CSARMP for commercial use without CSARMP’s written consent. As a condition of its use, you promise not to use CSARMP for any purpose that is unlawful or prohibited by these Terms & Conditions.
This subscription agreement (the "Terms & Conditions") is a legal agreement between you (referred to hereinafter as "you", "your," "user", or "subscriber") and CSARMP, including all of subsidiary and affiliated entities (referred to hereinafter as "CSARMP", "we", "us", or "our").
Subscribing to our services requires that you agree to the following Terms & Conditions. You agree to be legally bound by these Terms & Conditions by clicking on the "Agree & Continue" button provided.
IF YOU DO NOT AGREE TO THESE TERMS OF USE, YOU MUST NOT SUBSCRIBE TO CSARMP.
CSARMP comprises of customized functions to assist subscribers in developing and maintaining accurate child support and spousal support audits, and accurate child custody and visitation percentages, calendars and notes.
Each auditing program is designed to comport with the applicable laws of the state exercising jurisdiction over the issue of child and/or spousal support. However, CSARMP makes no guarantee as to the accuracy of your audit.
Each subscriber is responsible for the accuracy of the information used to calculate and prepare their audit. The “Help Message” instructions are provided to assist the subscriber in the proper use of CSARMP.
CSARMP is not a law firm or a licensed attorney service. Therefore, the information presented throughout this site shall not be construed as legal advice. Should you need legal advice, you should consult a licensed attorney in the state that has jurisdiction over your legal matter.
PRIVACY TERMS
CSARMP maintains strict privacy terms. Subscriber information will not be shared or disseminated to persons or entities except those affiliated with CSARMP, including parent company and subsidiaries, and only for the purpose of facilitating the use of CSARMP.
PAYMENT REQUIREMENTS
Each subscriber must pay an initial subscription fee of $25.00 plus a monthly fee of $14.50. A valid credit or debit card is required for the subscription. Each month, $14.50 will be charged to your debit or credit card. A credit or debit card must remain valid in order to continue uninterrupted access to CSARMP.
SERVICE CANCELLATION
Subscribers may cancel service at any time by accessing the Account menu and pulling down to the service cancellation link. The program will guide the subscriber through the simple cancellation process. Once the process is complete, the subscriber service will cancel within fifteen days. All data will be archived in the CSARMP data base for thirty days after service cancellation. The subscriber may access the archived data by resubscribing to the service within thirty days after cancellation. Thereafter, a flat fee will be required to access the archived data.
SERVICE TERMINATION
Subscribers will be notified approximately fifteen days prior to the expiration of their credit or debit card. Should their credit or debit card expire or otherwise fail to clear on the day payment is due, subscriber must provide a valid payment card within thirty days after the service terminates in order to access archived data. When resubscribing, initial setup fees will apply.
INTELLECTUAL PROPERTY
You acknowledge that Child Support Audits, LLC. owns all rights, title and interest in and to CSARMP, portions thereof, and/or services provided through the CSARMP web site, including, without limitation, all Intellectual Property Rights. "Intellectual Property Rights" means any and all rights existing from time to time under patent law, copyright law, trade secret law, trademark law, unfair competition law, and any and all other proprietary rights, and any and all applications, renewals, extensions and restorations thereof, now or hereafter in force and effect worldwide. You agree not to modify, adapt, translate, prepare derivative works from, decompile, reverse engineer, disassemble or otherwise attempt to derive source code from the CSARMP web site, incuding printed work therefrom. You also agree to not remove, obscure, or alter any copyright notice, trademarks, or other proprietary rights notices affixed to or contained within or accessed in conjunction with or through CSARMP.
DISCLAIMER OF WARRANTIES
CSARMP DISCLAIMS ANY RESPONSIBILITY FOR ANY HARM THAT MAY RESULT FROM YOUR USE OF CSARMP.
CSARMP ISSUES NO WARRANTIES AS TO THE ACCURACY OR RESULTS OF CSARMP. CSARMP EXPRESSLY DISCLAIMS, TO THE FULLEST EXTENT PERMITTED BY LAW, ALL EXPRESS, IMPLIED, AND STATUTORY WARRANTIES, INCLUDING, WITHOUT LIMITATION, THE WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT OF PROPRIETARY RIGHTS.
SOME STATES OR OTHER JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF IMPLIED WARRANTIES, SO THE ABOVE EXCLUSIONS MAY NOT APPLY TO YOU. YOU MAY ALSO HAVE OTHER RIGHTS THAT VARY FROM STATE TO STATE AND JURISDICTION TO JURISDICTION. CSARMP HEREBY DISCLAIMS ALL WARRANTIES TO THE FULLEST EXTENT PERMITTED BY LAW.
MISCELLANEOUS PROVISIONS
1. These Terms & Conditions will be governed by and construed in accordance with the laws of the State of California without reference to conflict of law principles.
2. If for any reason a court of competent jurisdiction finds any provision or portion of these Terms & Conditions to be unenforceable, the remainder of these Terms & Conditions will continue in full force and effect.
3. Any waiver of any provision of these Terms & Conditions will be effective only if in writing and signed by a duly authorized agent of Child Support Audits, LLC.
4. We may immediately terminate these Terms of Use with respect to you without cause and without notice to you in our sole discretion.
5. The provisions of these Terms of Use, which by their nature should survive the termination of these Terms of Use, shall so survive such termination.
6. These Terms of Use along with any other notices, policies, procedures, agreements, and terms and conditions on our Site contain the entire understanding with respect to your use of CSARMP and our relationship with you, and such shall supersede all prior understandings and agreements, whether written or oral, and all prior dealings.
7. YOU AGREE THAT REGARDLESS OF ANY STATUTE OR LAW TO THE CONTRARY, ANY CAUSE OF ACTION AGAINST US ARISING OUT OF OR RELATED TO OUR CSARMP SITE MUST COMMENCE WITHIN ONE (1) YEAR AFTER THE CAUSE OF ACTION ACCRUES OR SUCH CAUSE OF ACTION SHALL BE PERMANENTLY BARRED.
